Please be aware that under the latest version of the JCT (Revision 2 2009) Form of Contract, in the Contract Particulars Part 1 there are two new additions under clause 6.11

(Professional Indemnity Insurance) that can require the Contractor to have Professional Indemnity insurance for asbestos and fungal mould claims. We have consulted with the major Professional Indemnity insurers and at this moment in time, this cover cannot be purchased. As such, when reviewing any JCT Revision 2 2009 contracts, you will need to ensure that the "is not required" option is selected (as per the below). As this cover cannot be purchased, all your competitors should be doing the same otherwise they would be in breach of contract.
